Welcome! The following are the terms of use (“Terms”) that govern your use of the websites and applications where this appears (collectively, the “site”). Our Privacy Policy and any other policies, rues, guidelines that may be applicable to particular offers or features on the site are also incorporated into these Terms. By visiting/using the site or purchasing a ticket, you expressly agree to these Terms, as updated from time to time.

We may make changes to these Terms at any time Any changes we make will be effective immediately when we post a revised version of these Terms on our Site. The “Last updated” date above will tell you when these Terms were last revised. By continuing to use this site after that date, you agree to the changes.

An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death.

You assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogens capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against Zilker Train LLC and their affiliated companies relating to such risks.

  1. All riders must have a ticket.
  2. Children under 12 must be accompanied by an adult ticket.
  3. The Zilker Eagle is a cashless operation; only credit/debit cards are accepted online and at the depot.
  4. All sales are final – no refunds will be issued.
  5. Exchanges may be made under limited circumstances; email info@zilkertrain.org for assistance.
  6. Ticket valid only for day and time of purchase
  7. In the event of inclement weather, ride times will be canceled and tickets will be refunded or exchanged.
  8. In the event of unforeseen circumstances that cause a ride time cancellation, tickets will be refunded or exchanged.

All patrons, invitees, guests and volunteers (“Patron”) entering onto any Zilker Train LLC property or equipment or participating in any Zilker Train LLC event is considered voluntary participation and may subject a Patron to the possibility of physical injury, loss of life and loss of or damage to a Patron’s property (collectively, “Risks”) and the Patron agrees to the following waiver of liability of any Risks or Claims at Zilker Train LLC Activities:

a. The Patron agrees, to fullest extent permitted by law, to release and hold harmless Zilker Train LLC, its officers, directors, employees, agents, volunteers, and contractors (collectively, “Releasees”) from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these Risks (“Claims”), except those caused totally by the negligent acts or omissions of any or all of the Releasees: and,

b. The Patron agrees, to fullest extent permitted by law, to release and hold harmless Zilker Train LLC, its officers, directors, employees, agents, volunteers, and contractors (collectively, “Releasees”) from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these Risks and Claims; and,

c. The Patron agrees without exception to rely on Zilker Train LLC insurance liability coverage limits if the Patron asserts any Claims against Zilker Train LLC related to the Risks resulting from and during Zilker Train LLC Activities. For clarity, the Patron waives all rights of Claims or Damages against the Releasees except insurance coverage limits of Zilker Train LLC for such Claims or Damages.

d. This Agreement shall be binding on any Patron’s estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on behalf or on behalf of a Patron’s estate.

Photography and filming are conducted by Zilker Eagle and Austin Parks Foundation for marketing and educational purposes on the mini train, along the tracks and near the depot. Purchasing a train ticket constitutes your consent for the Zilker Eagle and Austin Parks Foundation to use any photos, images or video it deems appropriate without payment, inspection or review.

All rights to the photographs and video belong to the Zilker Eagle. If you want a photograph or video removed of yourself or your dependents on our website or social media, please contact us at marketing@zilkertrain.org.

Feel free to take photos and post about your visit! We love seeing and sharing visitor photos on our social media channels. Be sure to tag the @zilkereagle or use the hashtag #ZilkerEagle when posting photos/videos of your visit to make sure we see it. Please do your best to be considerate and respectful of others’ privacy when taking photos of more than just your group.
